The Website Rules shall enter into force on 5 July 2022.

Mastercard Europe SA, with its registered office in Waterloo, Chaussée de Tervuren 198A, B-1410 Waterloo, Belgium (hereinafter: “Mastercard”), as an interactive service provider would like to present www.Gdziezamieszkac.com website (hereinafter: “Website”) to be used for information purposes. The Website together with the tools made available thereon have been created for the citizens of Ukraine fleeing the war, who are seeking or have already found refuge in Poland. The Website will also be useful for any person interested in relocation, regardless of the reason and origin. We encourage you to use the Website. The use of the Website is free of charge.

Before entering the Website and using it, you shall accept these rules for the use of the services on the Website (hereinafter: “Website Rules” or “Rules”). If you do not accept the Website Rules, please do not use the Website.

Technical requirements and equipment

The Website would operate on all devices, such as PC, tablet, telephone. The Website is available both in the version for mobile devices and for desktops. Mobile devices shall be understood to mean portable electronic devices intended to be connected directly or indirectly to the network termination point, i.e. telecommunications terminal devices within the meaning of Article 2 point 43) of the Act of 16 July 2014 – Telecommunications Law (smartphone, tablet), using the operating system specified further in the Rules, enabling the use of the Website.

The Website can be used on any device with the up-to-date version of any web browser, with access to the Internet, e.g. a device enabling the User to access the Internet with software for browsing the Web (Internet Explorer 6 and later, Firefox 2 and later, Opera 9.27 and later, Safari 3.12 and later) with JavaScript enabled and Adobe Flash (version 9.045 and later) plugin installed, without any systems blocking Flash content, accepting cookies.

In order to ensure the correct functioning of the Website and the services, the User is obliged to make sure that software and devices used are up-to-date, especially as regards downloading new versions or updates.

Prohibited activities

The User shall use the Website in accordance with its intended purpose. Any activities inconsistent with the law and the Website Rules shall be prohibited when using the Website, which in particular refers to the activities that would destabilise operation of the Website, hinder access to the Website or the use thereof, violating generally accepted social norms, inconsistent with generally applicable legal regulations, violating rights of Mastercard or third parties, including the activities hindering operation or overloading tele-information systems also of other entities directly or indirectly participating in the provision of services by electronic means. In the case of a breach of the Website Rules by a natural person – Website user (hereinafter: “User”), including any unlawful activities, activities violating goods customs or the occurrence of circumstances resulting in instability of the Website, Mastercard shall be authorised to take steps to mitigate the effects of the violation.

Service description

Services made available to the Users on the Website involve presentation of information about the average monthly cost of living and the average remuneration in particular sectors in a selected locality in Poland. The average monthly cost of living for the particular household is calculated based on the answers provided by the User in the form on the Website. The results appear immediately after completing the form on the Website; they are also available in the form of a link that the User can save. The User can fill in any number of forms. To get the result, all questions must be answered. The User can save the results or send them as a link. The results are approximate and may change depending on the individual preferences and situation of the User and the changing economic situation.

The gdziezamieszkac.com tool is based on Mastercard’s anonymized transaction data and publicly available external sources, including long-term archived data regarding average salaries – obtained from Statistics Poland (GUS) – and job and rental listings from Gratka.pl to provide a personalized estimation of the average, basic costs of living and remuneration in the chosen location. The information provided relates to the period from June to December 2022.

The Website contains links to third party websites in order to enable the Users to collect more information.

Depending on the User’s preferences, the Website may be displayed in one of three language versions (PL/UA/ENG). The language version can be selected in accordance with the User’s preferences on the home page.

Average costs are presented in the currency selected by the User. The EUR/HRY exchange rate used on the Website is updated once a day based on the average exchange rate announced by the National Bank of Poland.

The Website shall not be used to compare offers or negotiate prices. Various economic factors, including individual terms and conditions depending on the suppliers of goods and services resulting in differences vs. average rates, affect final prices and costs of living.

After entering the location, the tool will help to find the nearest bank, where an account can be opened (“Show the banks” in the “Do you need a bank account in Poland?”).

Information obtained on the Website helps interested Users to search for a convenient place for a longer stay in Poland – not only in major cities.

Conclusion of the agreement for the provision of services by electronic means

The agreement for the provision of services by electronic means in accordance with the Website Rules shall be concluded upon each visit of the User on the Website, and the agreement shall be terminated upon the User leaving the Website.

Risks

Mastercard would like to inform you that it endeavours to make the use of the Website as safe as possible for Users. However, Mastercard would like to note that the potential risk of unauthorized access to the Website by third parties (so-called hacking), which may result in unexpected changes in the functioning of the Website, poses a serious threat related to the use of the Website, as in case of any other website.

To mitigate this type of risks (including, inter alia, operation of computer viruses, malware or spyware), it is important that the User installs and updates, on an ongoing basis, anti-virus programs on his/her device through which he/she connects to the Internet.

Maintenance works

Mastercard shall have the right to temporarily suspend the services on the Website for the purposes of carrying out necessary maintenance or data security works, in such a way as to minimise the inconvenience to Users. The above applies without affecting the scope of the rights and obligations of the Parties.

Right to use the content posted on the Website

Mastercard grants the User limited, non-exclusive, revocable authorisation to view, share, print and download content, as defined below, from the Website for the User’s personal use. Mastercard does not grant the User the right to license, republish, distribute, copy, transfer, sublicense, transfer or sell the content on the Site, to prepare derivative works based thereon or to use the content on the Site in any other way for any purposes other than own use. No content may be reproduced in any form or become part of any electronic or mechanical information retrieval system, other than the system used for own purposes of the User. It shall be prohibited to use the Website in a way that could or would result in damage or deterioration of the condition of the Website, server or networks based on which the Website functions, as well as interfere using the Website by other persons. We also grant the User a limited, revocable and non-exclusive right to create links or references to the Website or any Content published thereon, provided that those links do not represent Mastercard, its products and services in a false, misleading, negative or otherwise derogatory way or suggest that the linked site, bookmark or content is sponsored or endorsed by Mastercard.

It shall be prohibited to use automatic login systems (e.g. robots, web spiders, etc.) to access the Website. The User is not allowed to collect personal data of other users of the Website, sell these data or use them in any other way, except for the limited rights expressly granted to the User in the Website Rules; all rights and titles to, as well as benefits from the Website and all content published thereon are reserved and remain the property of Mastercard.

Changes on the Website and amendments to the Rules

Mastercard reserves the right to change or modify the content, materials or information made available on or related to the Website, including the Website Rules, for important reasons that include formal reasons (such as amendments to the law, administrative decisions), economic reasons (ownership changes, changes in the market situation), technology changes, introduction of new services or functionalities. Mastercard may make corrections to the Website Rules by publishing them on the Website. These amendments shall come into force on the date specified by Mastercard, no less than 14 days since the date of making available a new version of the Rules. The aforementioned amendments shall not violate already acquired rights of the Users and legal regulations. Amendments to the Rules shall be binding on the User, and therefore we encourage the User to verify the tab with the Rules in order to check the current version of the Rules.

Intellectual property rights

The content published on the Website is protected by relevant intellectual property rights and is the exclusive property of Mastercard or Mastercard uses it based on a license or upon the consent of the entitled person. Text, formatting (including selection, organisation and layout of materials on the Website, images, graphics, animations, tools, widgets, applications, advertisements, video materials, music, sound, articles, reproductions, creative materials, photos, trademarks, service marks , trade names, logos and other materials and information) on the Website are subject to the intellectual property rights of Mastercard, its subsidiaries and affiliates, as well as individual licensors and licensees (hereinafter collectively referred to as the “Content”). It shall be prohibited to copy, reverse engineer, decompile, disassemble, modify, republish on other website, frame, create deep links to, change or distribute in any other way, redistribute, license, sublicense or transfer these materials in any form whatsoever. Nothing on the Website should be interpreted as granting, in an implied way, by reference to facts or circumstances inconsistent with previous declarations or activities on the Website, a licence or right to commercially use the trademark of Mastercard, intellectual property rights or rights to materials protected by the copyright, without the prior written consent of Mastercard. Trademarks, logos, trade names and service marks, registered or unregistered (hereinafter collectively referred to as the “Trademarks”) displayed on the Website are Trademarks of Mastercard and parties to contracts with third parties. Nothing on the Website should be interpreted as granting, in an implied or any other way, any licence or right to any Trademark disclosed on the Website, without the prior written consent of Mastercard or a third party that is the owner of the Trademark. Any unlawful commercial use of the aforementioned materials shall be considered a breach of intellectual property rights of Mastercard, and Mastercard shall be entitled to pursue any claims in relation thereto.

Intellectual property

Within the framework of activities related to the functioning of the Website, Mastercard may act as a “service provider” and offer services as an online provider of materials and links to third party websites. As a result, third party materials that are not the property and are not controlled by Mastercard may be transmitted, stored, accessed or otherwise made available on the Website. Mastercard has implemented certain procedures regarding allegations of copyright infringement occurring on the Website and adopted the policy providing for the prompt removal of any content or suspension of access to the Website for users found to have infringed on the rights of Mastercard or of a third party, or that has otherwise violated any intellectual property rights, other legal regulations or provisions of the Rules. Mastercard will respond expeditiously to remove or disable access to the material claimed to be infringing and will take steps aimed at resolving the divergences between the notifying party and the alleged infringer who provided the Content.   3. astatementbytheUserthattheUserhasagoodfaithbeliefthatthedisputeduseisnotauthorized by the copyright owner, its agent, or the law;
  4. address, telephone number and email address of the User.

Third party content and links to other websites

The Website may contain third party content and links to other completely independent websites. Third party content and links are included only for the convenience of Users, and do not mean an approval, recommendation or endorsement by Mastercard. Additionally, Mastercard shall not be held liable for the accuracy, completeness or reliability of third-party information, or any products and services that may be sold through a linked site. Any contracts, transactions and other arrangements between the User and third parties shall be concluded and made at the risk of the User and such third parties. If the User clicks on a link to a third-party website, the User will leave the Website. Mastercard does not collect and control personal data provided by the User on the website to which the user was redirected, and provisions of the privacy policy or terms of use of that website will apply. The controller of personal data provided by the Users shall be Mastercard, unless otherwise decided by the rules of particular programmes or functionalities of the Website. Civil liability of the User

The User shall be held liable for any infringement by the User of the Website Rules or improper use of the Website, in accordance with provisions of the law.

Exclusion of liability for damage

NOTHING IN THESE WEBSITE RULES SHALL EXCLUDE OR LIMIT LIABILITY OF MASTERCARD: (I) FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE OF MASTERCARD; (II)FOR FRAUD OR MISREPRESENTATION; AND (III) IN ANY OTHER INSTANCES, WHERE EXCLUSION OR ATTEMPT TO EXCLUDE LIABILITY OF MASTERCARD IS PROHIBITED BY LAW.

Miscellaneous

The Website Rules shall be read, interpreted and applied to the Users in the territory of Poland in accordance with the Polish law to the extent it is applicable, and shall be subject to the jurisdiction of Polish courts to the extent permitted by the Polish law. The competent court shall be the court competent for the User as a consumer, and in case of Users, who are not consumers – the common court in Warsaw. A consumer shall be understood to mean a natural person or a person using the Website for a purpose unrelated directly to his/her business or professional activity, or a natural person concluding a contract related directly to his/her business activity conducted based on an entry in the Central Register and Information on Economic Activity (CeiDG) if the content of this contract indicates that it is not a professional activity.

The User cannot directly or indirectly use, distribute, send or transmit content or software from the Website in the form of direct products or such materials, products, software or other technical information containing content or software from the Website, except when allowed by the law. Mastercard may transfer the rights and obligations arising from the Rules at any time, provided that such transfer is allowed by the law.

If any section or provision of the Rules proves to be illegal, ineffective, invalid or unenforceable, this section or provision shall be considered excluded from the Rules and shall not affect the validity and enforceability of the remaining provisions. Except as otherwise provided in the Website Rules or legal regulations, the Website Rules constitute the entire agreement between the User and Mastercard with respect to the subject matter of the Rules.

Failure of Mastercard to exercise its rights under any provision of the Rules shall not constitute a waiver of those provisions or its right to exercise such provisions.

2. A complaint should contain at least the following information:
a) identification of the User (e-mail address);
b) subject matter of the complaint;
c) circumstances justifying the complaint (for instance: lack of access to the Website, functional interruptions).

3. If the complaint does not contain the data referred to in section 2 above or contains incomplete, incorrect or untrue data, Mastercard will request the User submitting the complaint to supplement the complaint.

4. Mastercard stipulates that an incomplete data make it impossible to examine the complaint until it is supplemented.

5. The complaint submitted by the User will be examined immediately, within 14 working days. The answer will be sent by e-mail, to the address provided by the User.

Effective date of the Website Rules

The Website Rules shall enter into force on February 15, 2023.
